Use of the Website, its features, and its functions (the Services) is subject to the following terms and conditions collectively known as the Terms of Service (TOS). By accessing the Website and using its Services, you, the client, automatically agree with the TOS listed on this page as well as any other terms and conditions published on other pages of the Website.

LINKS AND PARTNERS

The Website has links to other websites (the Linked Sites) which we hold no influence on and take no responsibility for. We shall not be liable for transactions made at, to, or with, Linked Sites or their owners, directors, agents, or employees.

CONTENT AND OWNERSHIP

Logos, images, videos, text, layout, and all other content and design available on the Website are the properties of Meg at Midnight Limited or its content, design, and software providers, thus prohibiting the use of all such content for commercial or promotional purpose without our prior knowledge and written approval. Use of content may be allowed at our discretion for the sole purpose intended and agreed upon.

Content and the Services available on the Website may be ammended or improved at any given time without advance or immediate notice to you.

PRIVACY AND SECURITY

The Privacy and Security page of the Website shall inform you on how we use and protect your data.

ELIGIBILITY

To be able to purchase products from the Website you must:

  1. Be 18 years of age or older;
  2. Have a valid debit or credit card; or
  3. Have a valid bank account;
  4. Provide us only with true and accurate data; and
  5. Acknowledge and agree with the TOS.

TERMS OF SALE

All products and Services are subject to availability. New stocks may be allocated to clients with advance orders. There may be prolonged delays on advance orders due to demand and production. No product shall be reserved until an official purchase is made.

Prices published on the Shop are inclusive of VAT which applies if you are ordering from within the United Kingdom or the European Union. VAT is taken out from orders originating from and arriving to the Rest of the World.

We reserve the right to cancel your order under any of the following circumstances.

  • The product being ordered has insufficient stock;
  • The product being ordered is discontinued with or without prior notice;
  • The country or destination of the order has delivery restrictions;
  • We can not get authorisation for payment;
  • You do not satisfy the TOS. 

A confirmation notice sent through email by us to you shall serve as the acknowledgement of an order and not the acceptance of an order. The acceptance of an order shall come in the form of a dispatch notice.

DISPATCH AND DELIVERY

We aim to process and dispatch orders within a 24 hour period. This may take longer at certain times of the year when the demand is high. Information about our delivery times are approximate only, and calculated from the date of dispatch.

We reserve the right to refuse a request on redirection of order once it has dipatched. You are responsible in ensuring that the delivery address you provide us is accurate and final.

Meg at Midnight Limited and its delivery service providers shall require a signature from anyone at your delivery address as formal acknowledgement of the receipt of the order. You agree that we may leave the parcel at the delivery address if no one is available to sign for it at the time of delivery.

CANCELLATION / RETURN / REPLACEMENT OF ORDER

You may cancel an order at any point prior to dispatch. 

You may replace a product only with a different size and/or colour. Replacement delivery is free of charge if you are located within the United Kingdom.

You may return or replace any order, with the strict exemption of knickers, if the following conditions are satisfied.

  1. The product must be returned to us in its original condition, with tags and labels intact;
  2. The product must be returned to us within 10 days of you initially confirming receipt of the order. We reserve the right to refund the late return of a product with a store credit that shall be valid for one calendar year from the date of purchase.

You have the option to refund a purchase through the original mode of payment or with a store credit that shall be valid for one calendar year from the date of purchase. Refunds made through the original mode of payment may take up to 10 days to appear in your account, processed from the date we receive the product. The length of processing is regulated by the banks, not us.

You shall recieve a full refund if you are located within the UK. If you are located from outside the UK, you may, depending on the laws of your country, claim a refund on customs duty or import VAT from your respective government.

Unless otherwise expressly stated on any page of the Website, all manner of contact from you shall be made in writing using the electronic form or other information available on the Contact page of the Website. Any correspondence from you may be recorded.

LIMITATIONS OF LIABILITY

We shall not be liable to you for any implied guarantee or warranty of materials published on the Website. This does not affect your statutory right as a consumer.

We make no guarantee or warranty that the Website will meet your computer or browser requirements, or that the pages of the Website will load error-free.

We shall not be liable to you for products returned to us if damaged or lost in transit, and a replacement or refund shall not apply under such condition.

We shall not be liable to you for conditions that may result directly or indirectly to your economic losses; or diminished reputation; or any other losses brought about by unpredictable conditions that are beyond our knowledge or control.

We do not limit our liability in the event of your death or personal injury arising from our negligence, fraudulent misrepresentation, or any other liability which can not be limited under the laws of England.

GOVERNING LAW

For the avoidance of doubt, the TOS shall be deemed to have been concluded in the UK and shall be interpreted and enforced in all respects in accordance with the laws of England.
